Stephen J. Leahu

As a seasoned IP attorney with a diverse scientific experience, Stephen has the expertise to counsel in all aspects of intellectual property protection and enforcement and deliver innovative solutions.

Stephen J. Leahu partners with clients to protect and enforce their rights in all areas of intellectual property law. He is Board Certified in Intellectual Property Law. His experience includes patents, copyrights, trademarks, trade dress, domain names, unfair competition, idea misappropriation and trade secrets.

Stephen has been actively involved in patent prosecution, post-grant proceedings before the Patent Trial and Appeal Board, litigation, licensing and the counseling of clients on their product development and transactions concerning intellectual property rights.  Stephen has represented clients in intellectual property litigation in various state and federal courts and before the International Trade Commission (ITC).  Stephen is a registered patent attorney and is licensed in Florida, Illinois and the District of Columbia.

Stephen’s diverse science and business background has enabled him to handle patented subject matter in a wide range of technologies and industry sectors.  To further his technical expertise, Stephen earned a Masters in Engineering with a focus in bioinformatics (including imaging informatics, molecular modeling and computed tomography) which complements his degrees in biochemistry and computer science.  Stephen earned a Certificate in Intellectual Property Law while completing his law degree and went on to earn a Masters in Intellectual Property Law.  In order to better assist clients with their global strategies, he was admitted to practice law as an English solicitor in England and Wales and studied Comparative International Intellectual Property Law at the Max Planck Institute in Munich, Germany under Donald Chisum, author of the leading treatise on patent law.

  • Ultra Products, Inc. v. Antec, Inc. et al., Case No. 6:08-cv-503-MSS-DAB, (J. Scriven, M.D. Fla. 2008) (Patent infringement): Assisted with the representation of patent owner in three related patent infringement lawsuits involving modular computer power supply technology.  Case was transferred to N.D. of California after extensive jurisdictional discovery.

Conway, M.D. Fla. 2010) (Patent Infringement and trademark infringement): Defended against patent infringement claims concerning methods for lubricating conveyor belts in beverage industry.  Case settled after extensive litigation and discovery involving inequitable conduct, indefiniteness and false marking.

Presnell, M.D. Fla. 2010) (Patent Infringement): Assisted patentee with obtaining permanent injunction preventing the manufacture, use, or sale of patented multi-pipe systems for drain field assemblies.

Sheriff of Orange County, Case No. 2010-CA-06673 (Ninth Judicial Circuit, Orange County, Florida 2010) (Copyright Infringement): Assisted with representation of SeaWorld as an intervenor concerning copyright protection of its videos and obtained an injunction prohibiting publication of graphic videos depicting death of orca trainer.

  • San Antonio Shoe, Inc. v. Penaljo of South Florida, Inc. et al., Case No. 0:12-cv-61192-KMW (J. Williams, S.D. Fla. 2012) (trademark infringement): Assisted shoe manufacturer in obtaining a permanent injunction against a retail store’s trademark infringement.
  • Liberty Counsel, Inc. v. Ohio Liberty Council Corp., Case No. 2:11-cv-789-JLG-EPD (J. Graham, S.D. Ohio 2011) (trademark infringement): Assisted pro bono client with enforcing trademark rights. Obtained a permanent injunction requiring defendant to permanently refrain from using Liberty Counsel’s trademarks and to change its corporate name.

Sharp, M.D. Fla. 2010) (trademark infringement and cybersquatting): Assisted an automobile dealership in obtaining permanent injunction against an automotive repair shop’s cybersquatting, trademark infringement, unfair competition and manipulation of Google and Yahoo Local business listings.
  • Skyventure Orlando, LLC v. Skyventure Management, LLC et al., Case 6:09-cv-00396-PCF-KRS (J. Fawsett, M.D. Fla. 2009) (trademark infringement and franchise violations) Assisted with the representation of plaintiff involving a franchise dispute concerning indoor skydiving wind tunnels. 
  • Freid v. eBay, Inc., Case No. 2008-SC-338773 (Ninth Judicial Circuit, Orange County, Florida 2008) (Internet law): On behalf of eBay, assisted lead trial counsel with obtaining dismissal of a consumer fraud claim based upon Section 230 of the Communication Decency Act immunizing computer service providers from liability for content provided by third parties.
