Eric D. Babych

Eric Babych has prepared and prosecuted countless patent applications in almost every country in the world. His international experience and perspective are invaluable to his U.S. and international clients who confront global issues every day, as well as those who are preparing for a future in the world marketplace. Thinking forward, Eric anticipates how protection strategies employed in one country will impact a patent’s strength half a world away, and develops approaches to minimize global risk.

A full-service patent lawyer, Eric has drafted freedom-to-operate, non-infringement, patentability and invalidity opinions, in addition to his prosecution work; and he has also provided support to various litigation teams. He has handled patent appeals before the United States Patent & Trademark Office and Oppositions before the European Patent Office.

As a former medicinal chemist and inventor, Eric speaks the language of his clients. While he handles a large amount of patent applications in the chemical and pharmaceutical arts, he also has significant experience working with mechanical inventions, medical devices, consumer products and electronics.

  • Eric has prosecuted patent applications throughout North America, Asia, Europe, Africa, Australia, and South and Central America.
  • When a patent in Korea jeopardized the work of a U.S. client, Eric worked with Brinks Gilson & Lione’s local associate to institute and manage the ensuing Korean patent invalidation trial.
  • As a medicinal chemist, Eric conducted complex research focused on cardiovascular and neurological diseases. Some of the molecules he developed can be seen in International Patent Application No. PCT/US2004/043609, titled Novel Spiroindoline or Spiroisoquinoline Compounds, Methods of Use and Compositions Thereof.
