Brinks attorney Robert Mallin will speak on a panel on Tuesday, October 15 entitled “Enforcement Post AIA: How Will it Impact IP Strategy?” The panel will explore: 

  • District Courts vs ITC
  • Which forum to select
  • How will it impact your Enforcement strategy?

At a special Lunch and Learn ITC Workshop, Brinks attorneys Carl Charneski and Lyle Vander Schaaf will be presenting “An Insider's View on ITC Enforcement Strategies.” This interactive workshop will provide insights on best practices and strategies in ITC section 337 IP investigations. Former ALJ Carl Charneski will provide his observations from behind the bench at the ITC and Lyle Vander Schaaf will provide his observations from his years serving at the ITC in the Office of General Counsel. Comparisons and contrasts with practice in the Federal Courts will be provided, including discussing the advantages and disadvantages of cases in the different forums. The workshop also will include a discussion of recent developments in practices and procedures at the ITC and predictions on how the practice might look in the future. The practices and procedures of the various ALJ's at the ITC will be discussed, as will the backgrounds and positions of the various Commissioners.
