Litigator Jeff Nichols To Present on PTAB Trials and Alice Motions at FCBA IP Law Symposium

CHICAGO—Jeff Nichols, a patent litigator and shareholder at intellectual property law firm Brinks Gilson & Lione, will moderate the panel session “True or False – PTAB Trials and Alice Motions Simplify the Case” at the Federal Circuit Bar Association’s (FCBA) Intellectual Property Law Symposium on March 15, 2017, at the University Club of Chicago.

Nichols will be joined by Chief Judge Sharon Prost of the U.S. Court of Appeals for the Federal Circuit, Judge Rebecca R. Pallmeyer of the U.S. District Court for the Northern District of Illinois, and three patent litigators for a discussion about whether trials before the U.S. Patent and Trademark Office’s Patent Trial and Appeal Board (PTAB) simplify patent infringement cases or make them more complex.

The panelists will consider the impact of multiple PTAB and district court proceedings on the Federal Circuit’s docket. They will also explore the impact of the uncertain scope of estoppel in cases in which the PTAB confirms the patentability of challenged claims, and whether the likelihood of success in a PTAB trial warrants granting a motion to stay. The session will conclude with a discussion of whether Alice motions unduly prolong litigation, and of the circumstances under which a district court may wish to address such motions.

Nichols has extensive experience in patent litigation, particularly in the biotechnology and pharmaceutical industries. He frequently speaks on patent litigation and post-grant proceedings, and is an adjunct professor at The John Marshall Law School. Nichols is co-chair of Brinks’ biotechnology and pharmaceutical practice group, and previously led the firm's litigation practice group.

The FCBA is a national organization for the bar of the U.S. Court of Appeals for the Federal Circuit. It offers a forum for dialogue between bar and court, government counsel, private practitioner, and corporate counsel about mutual concerns.
